(Hereinafter 'GRAFLEX'), established in Madrid, as an entity owner of this website (hereinafter, 'WEBSITE') wish to inform our users regarding our policy of processing and protection of personal data users, we keep the information necessary for the user to log in various sections of the website.

GRAFLEX is not responsible for the processing of personal data that has been collected on those websites that you were able to access through links, banners, highlights, etc., located on the website.

 

II. Collection and purpose of processing the user data.

The personal information you provide, as well as, where appropriate, all data generated by your navigation within the website will be stored and processed in files that are the responsibility of GRAFLEX with the purpose of managing the services offered on the website, being the recipient of the information that the user provides GRAFLEX. For this purpose, the consent of the same in the corresponding forms is collected.

In any case the provisions of Law 34/2002, of July 11, Services for Society and Information and Electronic Commerce, on communications of electronic commercial shall be observed.

In the event that users are requested for personal data by means other than the above, GRAFLEX hereby informs explicitly, precisely and unequivocally regarding the conditions under which personal data and the purposes for which it is collected go to be used, with the obligation to provide or not, the rights that assist the user, the conditions in which they can be exercised and any other additional information necessary.

The mandatory or voluntary nature of the delivery and collection of part or all of the personal details that users are requested will be advised at the time of collecting them. However, the delivery of inaccurate or incomplete information may result in inadequate, inefficient or faulty provision of the services offered to users. In this sense, the user confirms that the data provided in the relevant forms is  correct and that which they are  entitled to deliver.

 

III. Assignment and access to personal data of users.

Personal user data may be provided to other individuals and legal entities of GRAFLEX whose cooperation is necessary for the proper provision, management, administration, expansion and improvement of services offered on the Website, subject always to the provisions made in the Articles 11 and 12 of the Data Protection Act.

Similarly, GRAFLEX Foundation will have access to personal data of users to periodically submit information on their products and / or services.

In the event that GRAFLEX want to facilitate user data outside of the above cases, such assignment to users will be previously communicated, in order to obtain the unequivocal consent for the transfer of data.

IV. Rights of users as owners of their personal data.

GRAFLEX informs that the user may at any time decide on the treatment of their personal data, and can access the data that has been collected and processed by GRAFLEX about him; correct information which is inaccurate; cancel or oppose the data processing, that right is limited to cases where consent to the processing of data is not necessary, provided that a law otherwise provides, and when there are founded and legitimate reasons concerning a specific personal situation.

The notification shall contain the following information:

  • Name and surname.
  • Specific request of the application.
  • Address for notifications, date and signature of the user.
  • Documents relating to the request made, where appropriate.

GRAFLEX hereby informs users that the exercise of these rights is extremely personal, so the only user that can exercise these rights in respect of personal data is the legitimate holder. However, in exceptional cases where admitted, the authorized representative of the user may exercise the rights that attend to it as set out above, provided that the communication encloses the document evidencing such representation.

GRAFLEX states that the exercise of these rights by a non-legally authorized third user could assume the crime of disclosure of secrets provided for by the second paragraph of Article 197 of the Penal Code, punishable by imprisonment of one to four years and a fine of twelve to twenty four thousand Euros, without prejudice to other consequences that should be faced as a result of any civil or administrative actions to which they are entitled both as legitimate user as well as a holder of personal data as GRAFLEX.

V. Security.

GRAFLEX guarantees the adoption of security measures established by Article 9 of Law 15/1999, Protection of Personal Data and Royal Decree 994/1999 approving the Regulation of security measures approved automated files containing personal data.

These measures will be adequate to ensure the safety of personal data and avoid its alteration, loss, or unauthorized access, given the state of technology, the nature of the data stored and the risks they are exposed to, whether from human action or physical or natural means.

GRAFLEX does not record personal data in files that does not meet the conditions laid down by rules regarding their integrity and security, or in treatment centers, premises, equipment, systems, programs and supports.

In the event that third parties have access to personal data of users in order to provide a service to GRAFLEX, it assures users that the service delivery contracts signed with these companies, safety measures are stipulated that such third parties are required to take, because of the nature of the data they access and in accordance with the provisions of the Data Protection Act and Royal Decree 994/1999.

 

VI. Cookies.

In this sense, GRAFLEX, recommends that users read these policies before any registration process, so that the latter can make changes that affect them.

Such changes, if any, will be communicated in advance as may be necessary in the WEBSITE, subject to demand, where necessary, the consent of affected users when it is not considered granted under the terms and conditions listed herein.
